Micah Neville

Micah works in Aspiring Law's Litigation Team, helping clients navigate some of life's most difficult moments - from family law and relationship property, civil disputes, employment matters to resolving disagreements over a loved one's estate. 

Relationship property, family and care of children disputes

Micah advises clients on relationship property matters, including complex disputes involving trusts, companies, family businesses, significant assets, and financial contributions. He also acts in spousal maintenance claims and care of children and guardianship proceedings, always with an eye to practical, workable outcomes, not just the legal result.

Estate, trust and will disputes

Micah acts in estate and trust litigation, including claims under the Family Protection Act, challenges to the validity of wills, applications to validate and correct wills, and disputes involving testamentary capacity and undue influence.

Employment and civil disputes

Micah also advises on a range of employment and general civil disputes, including debt recovery, contractual disputes, and other civil litigation. He's committed to providing clear, practical advice and achieving efficient and effective outcomes through negotiation, mediation, or when needed, court proceedings. 

Where a matter requires specialist advocacy or falls outside his principal areas of practice, Micah works closely with experienced barristers to ensure clients get the right representation for their situation.

Some outcomes Micah has helped clients achieve: 

• An order for an unequal division of relationship property - a 70/30 split in his client's favour, with recognition of additional contributions made after separation. 
• Acting as junior counsel in successfully challenging the validity of a will on the grounds of lack of testamentary capacity, with undue influence argued in the alternative. 
• An order validating an unsigned will. 
• An order correcting a will where a drafting error meant it didn't reflect the deceased's true intentions. 

Outside of work, Micah enjoys spending time with his family and getting out on the water or the mountain - surfing, snowboarding, and wakeboarding.
