What is an Enduring Power of Attorney?

An Enduring Power of Attorney is a document that gives a person or persons who you have appointed as an attorney the authority to act on your behalf in the event that you become incapacitated and unable to make decisions for yourself during your lifetime. Our Enduring Power of Attorney questionnaire can help you get started.

Why have one?

People sometimes assume that their partner can make decisions on their behalf if something happens to them. But the reality is, without the right documents in place, that person would need to apply to the court to be able to act on your behalf and it can be a very expensive and distressing process.

Role of an attorney

Being appointed as someone's attorney is a great honour but with it comes great responsibility. Before agreeing to act as someone’s attorney, you need to know and understand what is involved and what the person’s wishes and intentions are. Once appointed you must always act in their best interests when making any decisions relating to their property or personal care and welfare.
